1 RETURN POLICY
1.1 Pursuant to Article 52 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, by returning the Products purchased on the Site within 14 (fourteen) days from the date of receipt of the Products.
1.2 To exercise the right of withdrawal, the customer must send an e-mail to the address: info@saraburglar.itcontaining: (i) the manifestation of the will to exercise the right of withdrawal pursuant to Article 52 of the Consumer Code; (ii) an indication of the products for which the customer wishes to make use of the right of withdrawal; (iii) the progressive order number communicated by Sara Burglar srl at the time of the purchase confirmation.
1.3 Also for the purpose of exercising the right of withdrawal, the Customer must also send to the same email address referred to in point 1.2 above, proof of the shipment of the Products by courier to Sara Burglar srl, via Luigi Einaudi, 198/200 Civitanova Marche (MC) 62012; the sending may take place together with the email communication referred to in point 1.2 above. or, alternatively, with a separate email to be sent in any case within the peremptory term of 5 days from the sending of the notice of withdrawal.
1.4 In case of exercise of the right of withdrawal, Sara Burglar srl will refund the full price of the Products as long as they are returned by the Customer in the same condition in which they were shipped, not worn, not used and not damaged, as well as accompanied by the relative receipt. original, with the authenticity tag and made intact. The products must be returned in their original packaging; if the box used for shipping is irreparably damaged, it is possible to use an equivalent box in terms of size and strength.
1.5 Sara Burglar srl reserves the right to refuse the return of those Products that do not comply with these requirements. In case of defective Products, the provisions of paragraph 4 “Lack of conformity” will apply. Refunds will be made with the same payment method used for the purchase.
1.6 The costs for returning the Products are charged to the Customer; any expenses incurred by the Customer for the return will not be refundable.
1.7 Sara Burglar srl undertakes to reimburse the Customer without undue delay and in any case within 14 days from the date of receipt by the same of the notice of withdrawal from the contract pursuant to art. 54 of the Consumer Code; she and she will send an e-mail notification once the refund has been made.
1.8 The Products subject to withdrawal must be returned by courier, taking care to keep the identification details of the shipment – to be sent in accordance with the previous point 1.3. –
to allow the tracking of the same; it is also recommended to insure the full amount of the asset as Sara Burglar S.r.l. will not be responsible for reimbursement or compensation relating to Products regularly shipped but:
(i) received damaged by circumstances not attributable to Sara Burglar S.r.l .;
(ii) not regularly delivered to Sara Burglar S.r.l. due to loss, theft or any circumstance not attributable to the company.
If the Customer wishes to modify or cancel the order already sent, he must promptly send,
and in any case before receiving the e-mail confirming the shipment, an e-mail to info@saraburglar.it.
Sara Burglar S.r.l. will do everything to satisfy the Customer’s request. However, once the Product has been shipped, the order cannot be canceled or modified. However, the Products shipped may be returned
and in this case reference will be made to the rules on the right of withdrawal described above.,
2. CUSTOM PRODUCTS
2.1 In accordance with the provisions of article 59, paragraph 1, letter c of the Consumer Code, the right of withdrawal, cancellation or return, which would otherwise be available, is excluded in the case of orders relating to customized products, for example items with names and / or writings specifically requested in the order through the engraving of the Customer’s initials on the Product, without prejudice to paragraphs 3, 4 and 5 below. With regard to these customizations, the Customer acknowledges that the graphic representation proposed on the Site may differ from reality: the images and photographs of the engraving may in fact not reflect the actual appearance of the final product..
3. PRODUCT REPLACEMENT
3.1. Sara Burglar S.r.l. intends to provide Customers with the possibility of replacing the Products purchased on the Site and for this purpose the Customer must necessarily follow the procedure indicated below.
3.2. Ithe Customer who is not fully satisfied or who believes there is a discrepancy with the order placed must keep all documentation relating to the delivery and the Product itself in its original packaging and immediately contact Sara Burglar S.r.l. by e-mail to the following address: info@saraburglar.it following the procedure referred to in paragraph 1 above.
3.3. The Product to be replaced must be sent to Sara Burglar S.r.l. in the original sending state, as provided for in paragraph 1.4.
3.4. Please note that in the replacement procedure, the amount paid by the Customer will first be refunded
with the same payment methods used by the Customer for the purchase (referred to in paragraph 6 of the general conditions of sale) and then the new transaction.
3.5. The fulfillment of the new order is subject to the availability of the requested Products.
3.6. The shipping costs related to the return of the Product are charged to the Customer.
3.7. The replacement Product will be sent to the Customer by courier without additional shipping costs being charged exclusively in the event that the replacement is made by the Customer due to a lack of the Product pursuant to paragraph 4 below.
4. CONFORMITY DEFECTS
4.1. If a Product sold by Sara Burglar S.r.l. should present a production defect and in any case for any lack of conformity relating to Products sold by Sara Burglar S.r.l. the Customer must immediately contact the online assistance at the address: info@saraburglar.it
4.2. The legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right to restore, without charge, the conformity of the goods by repair or replacement or, in the event that these remedies fail, to an adequate reduction in the price or termination of the contract. The Customer loses these rights if he does not report to Sara Burglar S.r.l. the lack of conformity within two months from the date on which you discovered the defect. The direct action to assert the defects not maliciously concealed by Sara Burglar S.r.l. in any case, it is prescribed within twenty-four months from the delivery.
5. ERRORS OR INACCURACIES
5.1. Sara Burglar S.r.l. undertakes to provide constantly updated information in the sections of the Site relating to the description and / or sale of the Products and will do its best to ensure that the description and / or photographic representation of the products on the site is as faithful as possible to the products themselves. However, it is not possible to guarantee the complete absence of errors and, taking into account the methods of digital presentation of the products, it is possible that the perception by the Customer of the description or graphic representation of the products does not exactly correspond to the product itself. The images and colors represented may appear different from the real ones for reasons related to the navigation browser used, or to the device monitor. Sara Burglar S.r.l. reserves the right to correct errors, inaccuracies or omissions even after an order proposal has been sent and also reserves the right to modify or update information at any time without prior notice. It is understood that in these cases any discrepancies found cannot be understood as a lack of conformity of the ordered product.
6. GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS
6.1. Sara Burglar S.r.l. guarantees the authenticity of all Products purchased on the Site. The “Sara Burglar” and “Burglar Jeans” branded products are made with the best materials, are packaged by artisans, and are all strictly and entirely MADE IN ITALY.
6.2. The “Sara Burglar” trademark, as well as all the figurative and non-figurative trademarks, service marks, present on the Products, on the related accessories and / or packaging, shape marks, whether registered or not, as well as all the illustrations, images and logos protected by copyright, and, more generally, all intellectual property rights relating to the Products are and remain the exclusive property of Sara Burglar Srl. The information, images, photographs, trademarks and generally the elements and materials made available through this Site are and will remain the exclusive property of Sara Burglar Srl; therefore, reproduction, partial or total (with the sole exception of personal and non-commercial use), distribution, publication, transmission, modification, in whole or in part, and the sale of information, images, are expressly prohibited photographs, trademarks, products and in general of the elements and all the material contained in this Site.
6.3. In particular, the names and brands “Sara Burglar” and “Sara Burglar S.r.l”, whether registered or not, are and will remain the exclusive property of Sara Burglar S.r.l. and its reproduction, distribution, publication, transmission, modification in whole or in part, as well as sale, are expressly prohibited for any reason or purpose.
7. APPLICABLE LAW AND JURISDICTION
7.1. These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law.
7.2. For disputes arising from the interpretation, validity and / or execution of these General Conditions, the mandatory territorial jurisdiction will be that of the Court of Macerata
